MAJOR domestic battery maker BYD Co. said in a statement Thursday it hasn't infringed the commercial secrets of companies related to Foxconn International Holdings Ltd. and doubted the basis of allegations by the Hong Kong-listed mobile-phone equipment maker.
BYD's statement follows Foxconn's statement Tuesday it had filed a lawsuit in the High Court of Hong Kong alleging Shenzhen-based BYD 'knowingly and intentionally?convinced former employees of its unit, Shenzhen Futaihong Precision Industry Co., and its sister company, Hong Fu Jin Precision Industry (Shenzhen) Co., of disclosing confidential business information.
BYD said Thursday that it hadn't been served with a writ by Foxconn in relation to the Hong Kong lawsuit.
But the company said it believes it hasn't infringed the commercial secrets of Foxconn companies and doubts the basis of the alleged claims, including the 5 billion yuan (US$651.89 million) compensation allegedly claimed by Foxconn companies as reported by local media.
BYD said it intends to 'vigorously defend?itself when it is served with the writ.
The Hong Kong proceedings come after legal action taken against BYD by Shenzhen Futaihong and Hong Fu Jin in June 2006 in the Shenzhen Intermediate People's Court, BYD said.
In the Shenzhen lawsuit, the two companies are suing BYD for damages of 5 million yuan for misappropriation of commercial secrets, BYD said.
BYD said it believes the legal actions in Hong Kong and Shenzhen are generated from the same incident.
The Shenzhen court has yet to rule on the proceedings and the lawsuit is ongoing, BYD said, adding the claim of 5 million yuan would be immaterial to the group in terms of operational impact.
